This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://replaymusic.co (the “Site”).
PERSONAL INFORMATION COLLECTED
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”
We collect Device Information using the following technologies:
COOKIES
Here is a list of cookies that we use. We have listed them here so that you can choose whether you want to opt-out of cookies or not.
_session_id, unique sessional token, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider's internal stats tracker to record the number of visits.
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Calculates the number of visits to a store by a unique customer.
cart, unique token, persistent for 2 weeks, Stores information about your shopping cart.
_secure_session_id, unique session identifier
storefront_digest, unique token, undefined If the store has a password, this is used to determine if the current visitor has access.
- “Log files” track activity on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons,” “tags,” and “pixels” are electronic files that record information about how you browse the Site.
Additionally, you provide data to perform the following actions:
(1) Creation of Seller Account and Submission of Advertisement
To post an ad, you must provide us with your first and last name, your email address, a password, the name of your store on Replay Music, your status as a private or professional seller, your telephone number, and your shipping address, your general terms and conditions of sale and your bank details (to receive payment for your sales)
We use, on the basis of our legitimate interest, a technology for automatic analysis of the content of the Advertisements, in order to detect unsolicited content, including fraudulent content. This technology is based on the information you provide when posting your Advertisement and in your User Account, the history of the latter and the technical data related to your use of the website.
The collection and hosting of this data is carried out through the online application Multi Vendor Marketplace, developed by the company Webkul Software Pvt Ltd (address: H-28, Sector 63, Noida, UP, 201301, IN) and whose general conditions and privacy policy are accessible from the page of the Shopify store through which we downloaded this application: https://apps.shopify.com/multi-vendor-marketplace?search_id=2a2d4a69-da7e-49f1-9c2e-6c4397b8071d&surface_detail=multi+vendeor&surface_inter_position=1&surface_intra_position=5&surface_type=search
(2) Creation of Replay Music User Account
When you create a user account or make or attempt to make a purchase through the Site, we collect certain information about you including your first name, last name, billing address, shipping address, payment information (payment method chosen, expiration date, etc.), email address, and phone number. Please note that your payment information is encrypted by the payment services we use (Shopify Pay, PayPal, and Obvy). This automatically collected information is referred to as “Order Information.”
When we use the term “Personal Information” in this Privacy Policy, we are referring to both Device Information and Order Information.
(3) Request for assistance from customer service
When you contact customer service via the contact form or by email at support@replaymusic.co, we collect and process the following information:
- Identification, contact and account data, including your email address, username and user ID number.
- Data relating to your request, i.e. any element provided in support of your request and/or useful for processing your request, for example: subject and description of your request (including, where applicable, elements relating to the transaction concerned by the complaint), documents/supporting evidence attached to the initial request or subsequently, history of exchanges with our customer service, account history, etc.
(4) Reporting Ads, Users or Reviews
To report an Ad, User or Review, you must have a User Account. When you use the Ad or User reporting form or contact us by email at support@replaymusic.co, we collect and process the following information:
- Data relating to the User Account making the report.
- Data relating to the Advertisement/User Account/Review that is the subject of the report, as well as to the User Account attached to the Advertisement/Review that is the subject of the report.
- Data relating to the report and in particular: reason for the report, message attached in support of the report, date and time of the report, history of reports relating to the same Advertisement/User Account or Review.
(5) Asking questions about a Listing or Making an Offer to Purchase at a price different from that of the seller
When you request additional information regarding an Advertisement or make an offer, we transmit your message and the data entered in any additional fields in the form to the Advertiser so that they can follow up on your contact request.
(6) Use of our Online Messaging (“chat”)
As part of our Online Messaging, you can contact us directly to ask us questions. This messaging is developed by the company Crisp (address: 2 Boulevard de Launay, Nantes, 44100, FR) and their general conditions and privacy policy are available on their website: https://crisp.chat/fr/terms/.
(7) Secure Payment and Sale
If you are a Seller and you carry out a Transaction via Secure Payment on our site, you must provide “Know Your Customer” information to our payment service providers Obvy or PayPal. They use this information to verify your identity, in accordance with regulations aimed at combating money laundering and the financing of terrorism.
This information is as follows:
- First and last name ;
- Postal address;
- Email address;
- Date of birth ;
- Beyond a certain threshold: Valid identity document (national identity card or passport) and;
- RIB.
To transfer money from your Wallet to your bank account, you will be asked for your IBAN.
Our service providers Obvy and PayPal process the so-called “Know Your Customer” information referred to above.
(8) Secure Payment and Purchase
If you are a Buyer and wish to make a payment to an Advertiser on our Site, we collect your payment data (number, expiration date and cryptogram of your bank). For this purpose, they are transmitted to our PCI-DSS certified service provider, which technically contributes to achieving the above purpose.
The funds you send to us are held in an Obvy or PayPal Escrow Account until the Transaction is completed.
(9) Payment solution in several installments via Obvy
When you use the Payment in installments Solution, you must inform us of:
- your first name,
- your name,
- Your email address
- your billing address,
- your phone number.
This data is transmitted to Obvy, which also processes the email address linked to your Personal Account and technical data or data linked to your order (IP address, order number, etc.).
(10) Delivery Service
If you are a Buyer and wish to use the Delivery Service as part of a Transaction, we collect the following data:
- First and last name ;
- Email address;
- Delivery postal code, in order to display the nearest relay point, or the delivery address;
- Your mobile phone number to notify you of the progress of your delivery.
This data is transmitted to the carrier, or to the Seller when it is responsible for organizing delivery with its own carrier.
If you are a Seller and wish to sell a Parcel via the Delivery Service, we collect your first and last name in order to display them on the Parcel Dispatch Note or Postage Slip.
(11) Declaration to the tax administration
If you are a private seller and have carried out more than 30 transactions and/or transactions for an amount greater than 2000 euros during the calendar year, you must provide the following information under tax regulations:
- First and last name ;
- Postal address;
- Date of birth ;
- Tax Registration Number (NIF) or “Tax Number”;
- Number of transactions;
- Amount of transactions;
If you are a Professional Seller and have carried out more than 30 transactions and/or transactions for an amount greater than 2000 euros during the calendar year, you must provide the following information under tax regulations:
- Business name or company name;
- Trading name of your company;
- Postal address of the head office;
- Intra-community VAT number or, failing that, SIRET/SIREN;
- Tax Registration Number (NIF);
- Number of transactions;
- Amount of transactions.
HOW DO WE USE YOUR PERSONAL INFORMATION?
Generally, we use the Order Information that we collect to fulfill any orders placed through the Site (including to process your payment information, arrange for shipping of your order, and provide you with invoices and/or order confirmations). Additionally, we use this Order Information to: (i) communicate with you; (ii) screen for fraud or potential risk; and when in line with the preferences you have shared with us, (iii) provide you with information or advertising relating to our products or services.
We use the Device Information (in particular your IP address) that we collect to assess potential fraud or risk, and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our advertising and marketing campaigns).
SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties who help us use it for the purposes described above. For example, we use Shopify to host our online store – to learn more about Shopify’s use of your Personal Information, please visit: https://www.shopify.com/legal/privacy. As noted above, we use your Personal Information to provide you with targeted advertisements or marketing messages that we believe may be of interest to you. When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
